Keith Clouse, a Dallas attorney who advises employers on employment-related issues, believes that an employer can minimize its exposure to employment lawsuits by simply treating its employees fairly and with respect during the termination process. 

A terminated employee who feels humiliated and mistreated is far more likely to sue a former employer than an employee who feels merely disappointed that the opportunity did not work out.  The decision to terminate an employee should be announced to the employee privately, and the employer should provide a legitimate business reason for the decision, such as a reduction in force or poor performance.  The employer should immediately pay the employee any earned but unpaid wages.  Then, the employer should give the employee adequate time to collect personal items, and, unless the employer believes a serious security or safety risk exists, the employer should allow the employee to leave the facilities without a security guard escort.  Finally, the employer should not challenge the employee’s right to collect unemployment compensation, unless circumstances clearly show that the employee should not receive the funds.
